Welcome to ARK Equipment LLC. By purchasing from or using this website, you agree to the following Terms and Conditions. Please read them carefully before placing an order.
1. General Terms
ARK Equipment LLC sells commercial, industrial, food production, and related equipment. Many items are used, pre-owned, surplus, or refurbished unless specifically stated otherwise. Product descriptions, photos, and condition notes are provided to the best of our knowledge.
By placing an order, the customer agrees that they have reviewed the listing, photos, item condition, shipping details, and any applicable notes before purchase.
2. Used Equipment and Item Condition
Unless clearly stated otherwise, items are sold as used equipment. Used equipment may show signs of wear, cosmetic imperfections, previous use, or age-related condition. ARK Equipment LLC makes reasonable efforts to describe each item accurately, but customers are responsible for reviewing all available information before purchasing.
All sales are considered final unless a return is approved by ARK Equipment LLC.
3. Payment
Payment must be completed before any item is released, shipped, crated, or scheduled for pickup. ARK Equipment LLC reserves the right to cancel any order if payment is not received, payment cannot be verified, or fraud is suspected.
4. Shipping, Freight, and Pickup
Shipping and freight costs are the responsibility of the customer unless otherwise stated in writing. Freight shipments may require crating, palletizing, handling, liftgate service, residential delivery fees, limited-access delivery fees, or other carrier-related charges.
ARK Equipment LLC is not responsible for carrier delays, freight company errors, damage caused by the carrier, or additional delivery charges imposed by the carrier. Customers are responsible for inspecting freight shipments upon delivery and noting any visible damage with the carrier before accepting the shipment.
5. Returns
Returns are only accepted if approved in advance by ARK Equipment LLC. Any return request must be submitted within [insert number] days of delivery.
If a return is approved, the customer is responsible for all return shipping costs, freight costs, packaging, crating, insurance, and any related return expenses unless otherwise agreed to in writing by ARK Equipment LLC.
Returned items must be received in the same condition as originally shipped. ARK Equipment LLC reserves the right to deny a refund or reduce the refund amount if the item is returned damaged, altered, incomplete, used improperly, disassembled, or missing parts.
Original shipping, freight, crating, palletizing, handling, and processing costs are non-refundable unless otherwise agreed to in writing.
6. Chargebacks and Payment Disputes
By placing an order, the customer agrees to contact ARK Equipment LLC directly to resolve any issue before initiating a chargeback, payment dispute, or reversal.
Customers agree not to file a chargeback or payment dispute for issues related to shipping delays, buyer’s remorse, failure to read the listing, freight costs, used condition, approved return shipping expenses, or other matters that could reasonably be addressed directly with ARK Equipment LLC.
If a chargeback or payment dispute is filed without first making a good-faith effort to resolve the issue directly, ARK Equipment LLC reserves the right to dispute the chargeback, provide documentation to the payment processor, suspend future sales to the customer, and pursue recovery of any losses, fees, shipping costs, chargeback fees, collection costs, or legal expenses allowed by law.
Nothing in this section limits a customer’s rights under applicable law.
7. Order Cancellations
Orders may not be canceled once an item has been packaged, crated, palletized, shipped, picked up, or otherwise prepared for delivery unless approved by ARK Equipment LLC.
If a cancellation is approved after work has begun, the customer may be responsible for any costs already incurred, including but not limited to packaging, crating, labor, freight scheduling, payment processing fees, and handling charges.
8. Inspection and Compatibility
Customers are responsible for confirming that an item will meet their needs before purchase. This includes, but is not limited to, size, voltage, phase, capacity, dimensions, power requirements, installation requirements, intended use, and compatibility with other equipment.
ARK Equipment LLC is not responsible for purchases made based on incorrect assumptions, improper installation, unavailable utilities, lack of compatibility, or failure to verify specifications before purchase.
9. Installation, Use, and Safety
Items sold by ARK Equipment LLC may require professional installation, inspection, cleaning, repair, certification, or modification before use. The customer is responsible for ensuring that all equipment is installed, operated, and maintained safely and in compliance with all applicable laws, codes, regulations, and industry standards.
ARK Equipment LLC is not responsible for injury, loss, damage, downtime, lost profits, or other claims resulting from improper installation, misuse, modification, or operation of equipment after sale.
10. Warranties
Unless specifically stated in writing, all items are sold as-is, where-is, with no warranties expressed or implied. ARK Equipment LLC makes no guarantee that used equipment will meet a specific requirement, pass inspection, comply with local regulations, or be suitable for a particular purpose.
Any manufacturer warranty, if applicable, is between the customer and the manufacturer.
11. Limitation of Liability
To the fullest extent permitted by law, ARK Equipment LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, business interruption, equipment downtime, product loss, labor costs, or replacement equipment costs.
ARK Equipment LLC’s total liability for any claim shall not exceed the amount paid by the customer for the item in question, excluding shipping, freight, crating, handling, and related fees.
12. Accuracy of Information
ARK Equipment LLC makes reasonable efforts to provide accurate descriptions, photos, pricing, and availability. However, errors may occur. ARK Equipment LLC reserves the right to correct errors, update listings, cancel orders, or refuse service at its discretion.
13. Refusal of Service
ARK Equipment LLC reserves the right to refuse service, cancel orders, block future purchases, or limit transactions for any customer who abuses policies, files improper disputes, engages in fraudulent activity, fails to complete payment, or violates these Terms and Conditions.
14. Governing Law
These Terms and Conditions shall be governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes shall be handled in the appropriate courts located in Wisconsin unless otherwise required by law.
